By accessing and using MV Restaurants (the "Site"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.
In these Terms, "MV Restaurants," "we," "us," and "our" mean the owner and operator of the Site from time to time, including any successor owner or operator to whom the Site or the business behind it is transferred (see Section 18). Where these Terms give us a right or place an obligation on us, that right and that obligation pass to the successor together.
MV Restaurants is an independent information platform about places to eat on Martha's Vineyard, Massachusetts. The Site provides restaurant listings, descriptions, hours of operation, pricing indicators, maps and related information, for reference only.
We check each restaurant's own website, social posts and posted signs, and we date what we publish. Even so, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability or availability of the information on the Site. Addresses, phone numbers, hours, menus, prices, seasons and whether a place is open at all can change at any time without notice, and a restaurant's own sources are not always up to date.
Addresses and directions: Street addresses and map positions are for general reference only. Restaurants move, and map positions are approximate. We are not responsible for any inconvenience, loss or damage resulting from inaccurate address information or navigation errors.
Reservations and ordering: Where reservation or ordering links are provided, they connect you to the restaurant's own system or to a third-party platform. We are not a party to any reservation, transaction or agreement made through those links, and we do not guarantee availability, pricing or fulfilment.
"Open now" and dated pages: Statements such as "open now," "hours confirmed" or "closed for the season" are computed from the information we hold and the date we last checked it. They are a guide, not a promise that a restaurant will be open when you arrive.
Always contact the restaurant: Please confirm address, hours, availability, prices and policies directly with the restaurant before you go.
Nothing on the Site is health, allergy or dietary advice. Menu descriptions, vegetarian, vegan or gluten-free notes and similar details come from the restaurant's own materials and may be incomplete or out of date. If you have an allergy or a dietary requirement, ask the restaurant directly before you order.
Notes about alcohol, such as whether a place serves it or allows you to bring your own ("BYOB"), are general information taken from the restaurant's own site. Rules differ from town to town on Martha's Vineyard and can change, and each restaurant sets its own policy, including any corkage fee. You must be 21 or older to buy, possess or drink alcohol in Massachusetts. Please drink responsibly and never drive after drinking.
No restaurant pays for its place in our lists, its position in search results or on the map, or what we write about it. Right now restaurants cannot pay for anything on the Site. If paid options are ever offered, they will be clearly labeled wherever they appear and will not change the order of any list.
Restaurant names, logos and trademarks belong to their owners and appear on the Site only to identify the restaurant. Their use does not imply any endorsement or connection.
A restaurant owner or manager can ask us to correct a listing, or to remove a photograph of their premises, through the contact form. We check the request and act on it, and we date the change.
The following are owned by MV Restaurants and are protected by applicable intellectual property laws:
Photographs contributed by readers remain the copyright of the photographer, who grants us a licence to publish them (see Section 8).
You may not reproduce, distribute, modify, create derivative works of, publicly display, scrape, or otherwise exploit any content from the Site without prior written consent. Linking to any page of the Site is always welcome.
When you send us a correction, a message, a restaurant claim or any other information, you confirm that it is accurate to the best of your knowledge and that you have the right to share it. You allow us to use the facts it contains to keep the Site accurate. We may edit, check, decline or remove anything sent to us, and we are not obliged to publish it.
Where information on the Site comes from someone else, such as a restaurant, a contributor or a reader, it remains their responsibility, and to the extent permitted by law, including 47 U.S.C. § 230, we are not liable for it. If you believe something on the Site is wrong or unlawful, please tell us through the contact form and we will review it.
If you submit a photograph through /submit-photo/, the permission wording shown on that page at the moment you submit governs what we may do with it. That wording is versioned, and a cryptographic hash of the exact text you were shown is stored alongside your submission, so the permission you gave can always be resolved back to the words you actually read, and you can never be held to terms written afterwards.
You keep the copyright to your photograph. The permission you grant is non-exclusive and royalty-free, and it transfers with the Site if the Site is sold. Your credit and your right to withdraw the photograph transfer with it (see Section 18). We are not obliged to publish anything submitted.
If you appear in any photograph on the Site and would like it removed, tell us through the contact form and we will take it down.
We respect copyright and expect visitors to do the same. If you believe material on the Site infringes your copyright, send a notice to contact@mvrestaurants.com with the subject "Copyright notice," including:
We remove or disable access to material identified in a valid notice and, where we can, tell the person who supplied it. That person may send a counter-notice with the information required by 17 U.S.C. § 512(g)(3). We will stop accepting material from anyone who repeatedly infringes.

The Site uses Google Analytics and a simple page-view counter of our own, but only after you press "Accept" in the cookie banner. Until then, and if you press "Reject," no analytics cookies are set and no page views are recorded. If your browser sends a Global Privacy Control or Do Not Track signal, we treat it as a rejection unless you choose to accept. Details are in our Privacy Policy and Cookies Policy.
The Site also uses your browser's local storage to remember preferences such as dark mode, favorite restaurants, recently viewed restaurants and view settings. This data stays on your device, and you can clear it at any time through your browser settings.
If you subscribe to the MV Dining Dispatch, you agree to receive emails about Martha's Vineyard dining news, restaurant updates and seasonal recommendations. We send nothing until you confirm your address through the link in our confirmation email. You can unsubscribe at any time with the one-click link in every email. Your email address is handled under our Privacy Policy.
The Site contains links to third-party websites, including restaurant websites, booking and ordering platforms and mapping services. We are not responsible for the content, privacy practices or availability of these sites. Your use of them is governed by their own terms and policies.
We want the Site to work for everyone, including people who use screen readers, keyboard navigation or other assistive technology, and we aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 at level AA. If any part of the Site is hard to use, please tell us through the contact form or at contact@mvrestaurants.com, and we will work to fix it and to get you the information you need in another way in the meantime.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
WITHOUT LIMITING THE FOREGOING, WE SPECIFICALLY DISCLAIM ANY WARRANTY REGARDING THE ACCURACY OF RESTAURANT ADDRESSES, DIRECTIONS, OPERATING HOURS, "OPEN NOW" STATUS, MENUS, PRICES, PHONE NUMBERS, ALLERGEN OR DIETARY INFORMATION, ALCOHOL POLICIES, RESERVATION AVAILABILITY, OR ANY OTHER RESTAURANT-RELATED INFORMATION DISPLAYED ON THE SITE. YOU ACKNOWLEDGE THAT RESTAURANT INFORMATION MAY BE OUTDATED, INCOMPLETE, OR INCORRECT, AND AGREE TO VERIFY ALL DETAILS WITH THE RESTAURANT BEFORE RELYING ON THEM.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MV RESTAURANTS, ITS OWNERS, OPERATORS, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE.
This includes, without limitation, damages arising from: reliance on restaurant addresses, directions, or location data; travel to an incorrect or outdated address; a restaurant being closed when the Site suggested it might be open; missed, unfulfilled, or incorrect reservations; transactions with restaurants or third-party ordering or booking platforms; reliance on listed operating hours, prices, menu, allergen or alcohol information; or any other information provided on the Site. It also includes damages for loss of profits, data, goodwill, travel expenses, or other tangible or intangible losses, even if we have been advised of the possibility of such damages.
The Site is free to use. To the fullest extent permitted by law, our total liability to you for all claims relating to the Site is limited to one hundred US dollars (US$100).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including any right you have under the Massachusetts Consumer Protection Act (M.G.L. c. 93A) that cannot be waived by agreement.
To the extent permitted by law, you agree to indemnify, defend, and hold harmless MV Restaurants and its owners, operators, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees and legal costs) arising out of or related to your violation of these Terms, content you send us, or your violation of any rights of a third party.
MV Restaurants may transfer, sell, assign, or merge its rights and obligations under these Terms, together with the Site, its domain names, all associated content, intellectual property, trademarks, the restaurant directory as a compilation, the contributed photo archive and the licences attached to it, subscriber lists and their consent records, analytics data, and business records, to any third party, at any time, without the consent of individual users. You may not assign your rights under these Terms.
On the effective date of a transfer, the acquiring party assumes the rights, obligations, and benefits under these Terms. It takes on the obligations as well as the rights: nothing about a change of ownership reduces what a user is owed under these Terms, the Privacy Policy, or the photo permission wording a contributor agreed to.
In particular, these survive a transfer unchanged and remain exercisable against the new owner:
Where user data transfers, Section 9 of the Privacy Policy governs, including the notice a subscriber receives.
Following a completed transfer, the acquiring party is solely responsible for its own acts, omissions, policies, and data practices from the effective date onward, and the previous owner is released from responsibility for them. Nothing in this section releases the previous owner from liability for its own conduct before that date.
The new owner may modify, replace, or discontinue any aspect of the Site, including these Terms, subject to Section 19 and to any right you hold under applicable law that cannot be waived by agreement.
This section survives any termination, expiration, or modification of these Terms.
We may update these Terms from time to time. The date at the top of this page shows when they last changed, and we note material changes on the Site. Changes apply from the date they are posted and do not apply to a dispute that arose before that date. Your continued use of the Site after a change means you accept the updated Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles.
If you have a complaint, please contact us first and give us 30 days to try to resolve it informally. If we cannot, any dispute arising under these Terms shall be brought in the state courts sitting in Dukes County, Massachusetts, or in the United States District Court for the District of Massachusetts, and you and we consent to their jurisdiction. Either of us may instead bring a claim in a small claims court where it qualifies.
These Terms, together with the Privacy Policy and Cookies Policy, constitute the entire agreement between you and MV Restaurants regarding your use of the Site. Any failure by us to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
