While we strive to keep restaurant information current and accurate, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, or availability of the information on the Site. Restaurant details, including but not limited to addresses, phone numbers, hours of operation, menus, prices, seasonal availability, and current operational status, may change at any time without notice.
Addresses & Directions: The street addresses and map-based directions provided on the Site are compiled from publicly available sources and are for general reference only. Restaurants may relocate, and addresses may become outdated. MV Restaurants is not responsible for any inconvenience, loss, or damages resulting from inaccurate address information or navigation errors. You should always verify a restaurant's current location directly with the establishment before traveling.
Reservations & Ordering: Where reservation or online ordering links are provided, these connect you to third-party platforms or the restaurant's own booking system. MV Restaurants is not a party to any reservation, transaction, or agreement made through these links. We do not guarantee availability, pricing, or fulfillment of any reservation or order. All booking details should be confirmed directly with the restaurant.
Data Sources: Information displayed on the Site is gathered from publicly available sources including, but not limited to, restaurant websites, Google Business listings, social media profiles, and public review platforms. Restaurant owners do not always keep these sources up to date, and as a result, information on the Site may be outdated or incomplete despite our best efforts. MV Restaurants does not independently verify every detail with each listed establishment.
Always Contact Directly: Users are strongly encouraged to contact restaurants directly by phone or through their official website to confirm all details, including address, operating hours, availability, dietary accommodations, and reservation policies, before visiting.

Photographs contributed by readers remain the copyright of the photographer, who grants us a licence to publish them. Restaurant names, logos, and trademarks belong to their respective owners and appear here for identification only.

The Site uses Google Analytics to collect and analyze usage data. By using the Site, you consent to the collection and processing of data by that service as described in our Privacy Policy and Cookies Policy.
The Site also uses browser localStorage to remember your preferences (such as dark mode, favorite restaurants, recently viewed restaurants, and view settings). This data is stored entirely on your device. You may clear this data at any time through your browser settings.
If you subscribe to our newsletter, you consent to receive periodic emails about Martha's Vineyard dining news, restaurant updates, and seasonal recommendations. You may unsubscribe at any time using the link provided in each email. Your email address will be handled in accordance with our Privacy Policy.
If you submit a photograph through /submit-photo/, the permission wording shown on that page at the moment you submit governs what we may do with it. That wording is versioned, and a cryptographic hash of the exact text you were shown is stored alongside your submission, so the permission you gave can always be resolved back to the words you actually read, and you can never be held to terms written afterwards.
You keep the copyright to your photograph. The permission you grant is non-exclusive and royalty-free, and it transfers with the Site if the Site is sold. Your credit and your right to withdraw the photograph transfer with it (see Section 13). We are not obliged to publish anything submitted.
The Site contains links to third-party websites, including restaurant websites, online ordering platforms, mapping services, font providers, and analytics providers. We are not responsible for the content, privacy practices, or availability of these external sites. Your interaction with any third-party site is governed by that site's own terms and policies.

WITHOUT LIMITING THE FOREGOING, WE SPECIFICALLY DISCLAIM ANY WARRANTY REGARDING THE ACCURACY OF RESTAURANT ADDRESSES, DIRECTIONS, OPERATING HOURS, MENUS, PRICES, PHONE NUMBERS, RESERVATION AVAILABILITY, OR ANY OTHER RESTAURANT-RELATED INFORMATION DISPLAYED ON THE SITE. USERS ACKNOWLEDGE THAT RESTAURANT INFORMATION MAY BE OUTDATED, INCOMPLETE, OR INCORRECT, AND AGREE TO INDEPENDENTLY VERIFY ALL DETAILS BEFORE RELYING ON THEM.
IN NO EVENT SHALL MV RESTAURANTS, ITS OWNERS, OPERATORS, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE.
This includes, without limitation, damages arising from: reliance on restaurant addresses, directions, or location data; travel to an incorrect or outdated address; missed, unfulfilled, or incorrect reservations; transactions with third-party ordering or booking platforms; reliance on listed operating hours, prices, or menu information; or any other information provided on the Site.
This also includes, without limitation, damages for loss of profits, data, goodwill, travel expenses, or other tangible or intangible losses, even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless MV Restaurants and its owners, operators, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees and legal costs) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
MV Restaurants may transfer, sell, assign, or merge its rights and obligations under these Terms, together with the Site, its domain names, all associated content, intellectual property, trademarks, the restaurant directory as a compilation, the contributed photo archive and the licences attached to it, subscriber lists and their consent records, analytics data, and business records, to any third party, at any time, without the consent of individual users. You may not assign your rights under these Terms.
On the effective date of a transfer, the acquiring party assumes the rights, obligations, and benefits under these Terms. It takes on the obligations as well as the rights: nothing about a change of ownership reduces what a user is owed under these Terms, the Privacy Policy, or the photo permission wording a contributor agreed to.
In particular, these survive a transfer unchanged and remain exercisable against the new owner:
Where user data transfers, Section 9 of the Privacy Policy governs, including the notice a subscriber receives.
Following a completed transfer, the acquiring party is solely responsible for its own acts, omissions, policies, and data practices from the effective date onward, and the previous owner is released from responsibility for them. Nothing in this section releases the previous owner from liability for its own conduct before that date.
The new owner may modify, replace, or discontinue any aspect of the Site, including these Terms, subject to Section 14 and to any right you hold under applicable law that cannot be waived by agreement.
This section survives any termination, expiration, or modification of these Terms.
We reserve the right to update or modify these Terms at any time without prior notice. Changes become effective immediately upon posting. Your continued use of the Site after any modification constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dukes County, Massachusetts.
These Terms, together with the Privacy Policy and Cookies Policy, constitute the entire agreement between you and MV Restaurants regarding your use of the Site. Any failure by us to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
